         CODE OF CONDUCT

CODE OF PROFESSIONAL CONDUCT AND ETHICAL STANDARDS

PREAMBLE

This Code applies to Members and Affiliates of the Irish Property and Facility Management Association ( "the Association")

The Association is the professional body representing the interests of Property and Facilities Managers. Its objective is to promote property and facilities management as a recognised management profession, to promote the highest standards in the Property and Facilities management profession, and to emphasise Members' and Affiliates' responsibility to society, to their clients, to their employers and to each other, as outlined in this Code of Professional Conduct and Ethical Standards ("the Code") by :

  • influencing relevant areas of public policy
  • contributing to relevant training programmes
  • encouraging and enabling the exchange of ideas and information
  • establishing strategic alliances
  • liasing with appropriate Government agencies on legislation and policy

The Association, having regard to the responsibilities incumbent on its Members and Affiliates because of the civil, economic and social role assigned to them, has adopted the Code to be observed by its Members and Affiliates. Each Member and Affiliate of the Association undertakes, as a condition of membership or affiliateship of the Association, to abide by the Code, and the Articles of Association, Bye-laws and Regulations of the Association.

Compliant Members are entitled to use the designatory letters MIPFMA ( Member of the Irish Property and Facilities Managers Association ).Affiliates mat not use this designation.If a Member ceases to be a Member of the Association, either by resignation or expulsion, he/she must cease usage of the designatory letters IPFMA from the date of cessation of membership.

Membership/Affiliateship is restricted to individuals only. No company, firm or other legal entity is entitled to claim membership, affiliateship or association with IPFMA by virtue of individual membership or affiliateship of any of its employees, directors or partners.

MEMBERS AND AFFILIATES OF THE ASSOCIATION UNDERTAKE:

  1. Professional Competence
    • To conduct themselves in a manner befitting a Member or Affiliate of the Association and not engage in any act or behaviour that could bring the Association into disrepute.
    • To act with all reasonable professional care, skill and forethought in managing the property and/or facilities entrusted to them.
    • To keep abreast of legislation, market conditions, new knowledge and techniques relating to property and facilities management, for the benefit of clients and colleagues generally.
    • Not to accept an assignment that is outside their field of experience, unless they secure, with the client or employer's approval, the assistance of a specialist whose contribution will be clearly defined.
    • Not to accept any assignment that the Member or Affiliate is unable to carry out competently.
    • Unless special circumstances prevail, not to unilaterally terminate any assignment without reasonable notice to the client.
    • To acquaint themselves of all essential facts relating to the property or facility for which they have accepted a commission, so as to fulfil their professional obligations without error, exaggeration, misrepresentation or concealment of facts.
    • To participate in Association activities and promote and protect its interests.
    • To promote education and training in the field of Property and Facilities management.
    • To contribute to public policy on matters relating to property and facilities management.
    • To encourage suitable candidates to apply for membership or affiliateship of the Association.
    • To abstain from any undertaking, or any form of publicity prejudicial to the good name of the profession, and abstain from any form of conduct liable to morally or materially prejudice fellow Members or Affiliates
  2. Civic Responsibility
    • To have due regard to the effect of their work and ensure that it causes as little adverse effect as possible, to the ecology or the environment, and wherever possible, promote sustainable friendly working methods.
    • To encourage the conservation of energy and the recycling of used products, packaging and materials.
  3. Agreements.
    • To ensure that the financial obligations and commitments relating to property or facilities contracts are expressed in writing, where appropriate, and that they accurately reflect the agreements reached by all the parties, who should each be given a copy of the contract at the time of signing.
    • To ensure that agreements provide exact and unequivocal information for all parties.
    • To inform the client, in clear and precise terms, the fee for the services to be rendered.
  4. Integrity
    • To ensure the highest standards in the execution of commissions.
    • Not to order for the account of a client, goods or services from a relation or an organisation in which they have an interest, without first advising the client of the relationship.
    • To promote transparency in pricing arrangements with clients.
    • To maintain separate bank accounts for clients' monies entrusted to their care and not to pledge these accounts in any way. Where appropriate, monies should be lodged on deposit, and interest accruing credited for the benefit of the client.
    • To keep detailed records of all transactions relating to clients with appropriate authorisation and documentation for expenditure.
    • To ensure that annual or other required periodic accounting is carried out promptly and efficiently and that where required, all necessary information is provided to facilitate the timely auditing of the books of account.
    • To ensure that they have appropriate and adequate Professional Indemnity insurance, which is their sole responsibility, and accept that the Association has no function or responsibility in monitoring or policing such insurance arrangements, nor has the Association any responsibility for consequences of a Member or Affiliate not having arranged such Professional Indemnity insurance.
    • While the undertaking of commissions from any particular client is a matter for the discretion of the individual Member or Affiliate, it is nevertheless expected that Members or Affiliates shall not discriminate unfairly. A Member or Affiliate must not discriminate because of gender, marital status, family status, race , sexual orientation, religion, age, disability or membership of the travelling community, in carrying out their duties as Property and Facilities Managers.
    • Not to undertake commissions where it would involve the Member or Affiliate in the furtherance of a crime or in some form of unprofessional conduct or where there is or might be a conflict of interest.
    • Where a Member or Affiliate has reasonable grounds for refusing to act for a particular client or act in a particular case, to immediately inform the client of his/her decision not to act.
  5. Association Name and Logo.
    • Not to use the title or logo of the Association without the express authority of the Council.
  6. Subscriptions
    • To pay annual membership/affiliateship subscriptions when due. Members or Affiliates in default on subscription payments by the due date decided by Council will be liable to expulsion from the Association.

DISCIPLINARY PROCEDURES

  1. The Council of the Association for the time being, or such other committee as Council may approve, shall act as the Disciplinary Committee in matters of complaints of alleged breaches of the Code.
  2. If a complaint is made to the Association, or it appears that a Member or Affiliate has acted in breach of the Code, the Member or Affiliate concerned shall be advised in writing by the Secretary and requested to respond. If the Member or Affiliate fails to respond, or responds in a manner which is considered unsatisfactory, the matter shall be referred to the Disciplinary Committee.
  3. The Disciplinary Committee shall consider the matter and if necessary, instigate further investigation.
  4. If the Disciplinary Committee concludes that a Member or Affiliate has been guilty of a breach of the Code, it may :
    1. Reprimand the Member or Affiliate in writing and/or ;
    2. Require the Member or Affiliate to give a written undertaking to refrain from continuing or repeating the conduct constituting the breach and/or ;
    3. Order the repayment of part or all of the fee to the client in the matter of the breach and/or ;
    4. Suspend the Member or Affiliate from the Association and/or ;
    5. Recommend to Council that the Member or Affiliate be expelled from membership or affiliateship.
  5. In the event of a recommendation under Paragraph 4.5, the Council shall consider
  6. the case fully and may :
    1. Decide that the Member or Affiliate has not been guilty of a breach of the Code or ;
    2. Accept the recommendation of the Disciplinary Committee or the Appeal
    3. Board, as described in Paragraph 6, and expel the Member or Affiliate, subject to compliance with the procedures set out in Article 30 of the Memorandum and Articles of Association or ;
    4. Accept the findings of the Disciplinary Committee or the Appeals Board, but in lieu of expulsion impose one of the other sanctions provided for in Paragraph 4.
  7. A Member or Affiliate aggrieved by any decision of the Disciplinary Committee or Council may appeal, in writing, to an Appeal Board within one month of such decision. The Board for each appeal shall be appointed by Council and shall consist of three members or former members of Council. The Appeals Board shall agree its own procedures in relation to the appeal. The Appeal Board may :
    1. Uphold the decision of the Disciplinary Committee or Council or ;
    2. Decide that the Member or Affiliate has not been guilty of a breach of the Code and rescind the decision of the Disciplinary Committee or Council or ;
    3. Decide that the Member or Affiliate has been guilty of the breach of the Code and vary the penalty imposed to another sanction provided within Paragraph 4.
  8. The Disciplinary Committee, the Appeal Board or Council shall give the Member or Affiliate concerned an opportunity of stating a defence either in writing or by personal attendance.
  9. A person who has acted as a member of the Disciplinary Committee may not act as a member of an Appeal Board dealing with the same matter.
  10. The Association shall be entitled to publish in its Newsletter, on its Web Site, in the general press or other publications, notice of the expulsion or suspension of a Member or Affiliate, together with details of reasons for such expulsion or suspension.

MEMBERS/AFFILIATES RIGHTS

Nothing in this code shall infringe on a Member's or Affiliate's right to due process and natural justice or his natural and constitutional rights.
